1. General
These Terms & Conditions govern all purchases made through the online store operated by HB Games & Cards, a sole proprietorship owned by Harm Buwalda, based in the Netherlands.
By placing an order on our website, you confirm that you have read, understood, and agree to these terms. If you do not agree with any part of these terms, please do not place an order.
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated date. Orders placed before any changes will be subject to the terms in effect at the time of purchase.
2. Products
We sell Yu-Gi-Oh! single cards, sealed trading card products (including booster boxes, tins, and structure decks), and card accessories such as sleeves, deck boxes, and playmats.
We make every effort to ensure product descriptions, images, and condition assessments are as accurate as possible. However, minor differences in appearance may occur due to display settings, lighting in product photography, or manufacturer variations.
Single cards listed with condition grades (such as NM Near Mint, EX Excellent, LP Light Play, or MP Moderate Play) are assessed in good faith based on industry-standard criteria. Condition assessments are subjective to a reasonable degree, and we inspect every card before listing. If you require additional images or clarification on a card's condition before purchasing, please contact us.
3. Orders
All orders are subject to product availability. We update our inventory regularly, but stock levels may change between updates. If an item you ordered is no longer available, we will notify you as soon as possible and provide a full refund.
We reserve the right to cancel any order at our discretion, including but not limited to cases of stock errors, pricing mistakes, suspected fraudulent activity, or abuse of our systems. In such cases, you will receive a full refund of any amounts paid.
An order is considered accepted only when we send an order confirmation email. Until that point, we may decline or cancel the order for any reason.
4. Pricing & Payment
All prices displayed on our website are in Euros (EUR) and include applicable VAT unless otherwise stated.
Prices may change at any time without prior notice. The price applicable to your order is the price displayed at the moment you complete your checkout.
Payment must be completed in full before any items are shipped. We offer multiple payment methods, which may include credit and debit cards, iDEAL, PayPal, and other supported providers. Payment processing is handled securely by third-party payment providers; we do not store your payment card details.
In the event of a pricing error on our website, we reserve the right to cancel the order and refund any payments made, even after an order confirmation has been sent.
5. Shipping
We ship orders using trusted carriers, which may include PostNL and DHL. Delivery time estimates provided during checkout or on our website are approximate and not guaranteed.
Delays caused by shipping carriers, customs processing, weather conditions, or other circumstances outside our direct control are not our responsibility. We will, however, assist you in tracking your parcel and communicating with the carrier where possible.
Once an order has been handed to the carrier, risk of loss or damage passes to you. We recommend selecting tracked and insured shipping options for higher-value orders.
We are not responsible for parcels returned to us due to an incorrect or incomplete address provided by the customer. In such cases, the customer is responsible for any additional shipping costs to resend the parcel.
6. Returns & Consumer Rights
As a business based in the Netherlands selling to consumers within the European Union, we comply with applicable EU consumer protection laws, including the right of withdrawal where legally required.
Single Cards:
Single cards may be returned only if the exact originally supplied item is returned in the same condition as received. Returned cards are carefully inspected for signs of swapping, tampering, or condition changes. If we determine that a returned card is not the original item or has been altered, the return will be refused and the item returned to you at your expense.
Sealed Products:
Sealed products (such as booster boxes, tins, and structure decks) may only be returned if they are unopened, factory sealed, and in their original condition. Any product that has been opened, tampered with, resealed, or damaged by the customer is not eligible for return unless the product was defective or incorrect upon arrival.
Damage or Issue Claims:
Any claim for damaged, defective, or incorrect items must be reported to us within 48 hours of delivery, supported by clear photographic or video evidence. Claims made after this period may not be accepted. We reserve the right to request additional information to assess your claim.
Return Process:
To initiate a return, contact us at contact@hbgamesandcards.com with your order details and reason for return. We will provide return instructions. Return shipping costs are generally the responsibility of the customer unless the item was defective or incorrectly sent.
7. Preorders
From time to time, we may offer products for preorder. Preorder availability dates displayed on our website are estimates provided by suppliers and are not guaranteed.
Supplier allocation issues, production delays, or distribution shortages may result in reduced quantities, delayed release dates, or cancellation of specific preorder items.
If a preorder item cannot be fulfilled due to supplier allocation or cancellation, you will receive a full refund of any amounts paid for that item. We will notify you as soon as we are aware of any allocation or cancellation issues.
Preorder items are charged at the time of order or according to the payment terms shown at checkout. Cancellations of preorders may be subject to our standard cancellation policy.
8. Withdrawal Rights
Consumers in the European Union have a 14-day withdrawal period after receiving the goods, where applicable by law. Full details and a withdrawal request form are available on our Returns & Withdrawal page.
- Customers are responsible for returning the products, including the cost and risk of return shipping.
- Returned products must be in their original condition, with all packaging, accessories, and components included.
- HB Games & Cards may deduct value from refunds if returned products show signs of use, damage, missing components, or otherwise reduced resale value, to the extent permitted by law.
- Sealed trading card products whose seal has been broken after delivery may be excluded from the right of withdrawal where legally permitted, given their nature as randomized collectible items.
Nothing in this section limits any mandatory statutory consumer rights you may have under Dutch or EU law.
9. Liability
To the maximum extent permitted by applicable law, HB Games & Cards is not liable for any indirect, incidental, consequential, or special damages arising from the use of our website or the purchase of our products, including but not limited to loss of profits, loss of data, or loss of business opportunities.
Our total liability to you for any claim arising from or related to your purchase shall not exceed the total amount paid by you for the specific order giving rise to the claim.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
10. Fraud & Abuse
We take fraud and abuse seriously. We reserve the right to cancel any order, suspend accounts, or refuse future service if we suspect fraudulent activity, payment disputes without valid cause, repeated abuse of our return policy, or any other behavior that we reasonably believe is harmful to our business or other customers.
In cases of suspected fraud, we may report the matter to relevant authorities and payment processors. We also reserve the right to share relevant information with law enforcement or anti-fraud agencies where permitted by law.
11. Privacy
Your privacy is important to us. All personal data collected during your use of our website and purchase of our products is handled in accordance with our Privacy Policy. We encourage you to read the Privacy Policy to understand how we collect, use, and protect your information.
12. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Netherlands. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the Dutch courts, where legally permitted.
For EU consumers, nothing in these terms affects your mandatory statutory rights under EU consumer protection law.
